Agreement to Terms

By accessing or using the Sovereign Crypto Regulatory Supervision Platform ("Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the Platform.

1. Eligibility and Access

Access to the Platform is restricted to:

  • Authorized personnel of the Financial Intelligence Centre of Ghana
  • Authorized personnel of the Bank of Ghana
  • Authorized personnel of the Securities and Exchange Commission Ghana
  • Licensed Virtual Asset Service Providers (VASPs) operating in Ghana
  • Other authorized government agencies with regulatory oversight responsibilities

Users must be at least 18 years of age and have received proper authorization from their respective organizations to access the Platform.

2. User Accounts and Credentials

Users are responsible for:

  • Maintaining the confidentiality of their login credentials
  • All activities that occur under their account
  • Immediately notifying the FIC of any unauthorized access or security breaches
  • Ensuring that their account information is accurate and up-to-date

Sharing of login credentials is strictly prohibited. Multi-factor authentication must be enabled and maintained at all times.

3. Acceptable Use

Users agree to use the Platform only for:

  • Legitimate regulatory and supervisory purposes
  • Anti-money laundering and counter-terrorism financing activities
  • Compliance monitoring and reporting
  • Investigation and intelligence analysis as authorized
  • Training and certification activities

4. Prohibited Activities

The following activities are strictly prohibited:

  • Accessing the Platform for personal or commercial purposes unrelated to regulatory duties
  • Sharing, selling, or disclosing confidential information obtained through the Platform
  • Attempting to circumvent security measures or access controls
  • Using automated tools, bots, or scripts to access the Platform
  • Reverse engineering, decompiling, or attempting to extract source code
  • Introducing malware, viruses, or other harmful code
  • Using the Platform to harass, threaten, or harm any person or entity
  • Violating any applicable laws, regulations, or professional standards

5. Confidentiality and Data Protection

All information accessed through the Platform is confidential and protected under applicable laws including the Data Protection Act, 2012 (Act 843) and the Anti-Money Laundering Act, 2020 (Act 1044).

Users agree to:

  • Treat all Platform data as confidential government information
  • Only access information necessary for their authorized duties
  • Not disclose information to unauthorized parties
  • Report any suspected data breaches immediately
  • Comply with all data retention and disposal requirements

6. Audit and Monitoring

All Platform activities are logged and monitored for security and compliance purposes. By using the Platform, users consent to:

  • Recording of all login and logout activities
  • Tracking of all data access, modifications, and exports
  • Session recording for security analysis
  • Regular audits of user activities
  • Investigation of any suspicious or unauthorized activities

7. Intellectual Property

The Platform and all its contents, including but not limited to software, text, graphics, logos, and images, are the property of the Financial Intelligence Centre of Ghana and are protected by applicable intellectual property laws.

Users are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for authorized regulatory purposes.

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind. While we strive to maintain accurate and up-to-date information, the FIC does not warrant that:

  • The Platform will be uninterrupted or error-free
  • All information from third-party data providers is complete or accurate
  • The Platform will meet all specific user requirements

Users should independently verify critical information and exercise professional judgment in all regulatory decisions.

9. Limitation of Liability

To the maximum extent permitted by law, the Financial Intelligence Centre, its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the Platform.

10. Violations and Enforcement

Violations of these Terms may result in:

  • Immediate suspension or termination of Platform access
  • Disciplinary action by the user's employing organization
  • Civil or criminal prosecution under applicable laws
  • Revocation of professional licenses or certifications

The FIC reserves the right to investigate and take appropriate action against any user who violates these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ghana.

12. Changes to Terms

The FIC reserves the right to modify these Terms at any time. Users will be notified of material changes through the Platform. Continued use of the Platform after such modifications constitutes acceptance of the updated Terms.
